These Terms & Conditions govern access to and purchases through the e-commerce platform operated by Nuqt FZE LLC, SPC Free Zone, Sharjah, United Arab Emirates ("NUQT", "we", "us", "our"). By using the Platform or placing an order, you agree to these Terms.
Where NUQT sells an Artwork as agent for an identified artist, the artist remains the creator and source of the Artwork and NUQT facilitates the sale, payment, marketing and delivery arrangements. Where NUQT is stated to be the seller/principal for a transaction, the order confirmation will govern that status.
You must have legal capacity to contract and, where required by applicable law, be at least 18 years old. You are responsible for account credentials and for information supplied through your account.
Many Artworks are unique, one-of-one or available in limited editions and may remain in the Artist's possession until sold. A listing is an invitation to place an order and does not guarantee that the Artwork remains available. Because an Artwork may also become unavailable before the Artist updates NUQT, availability is verified with the Artist after an order is placed. If an Artwork is unavailable after payment has been collected, the affected order will be cancelled and the amount paid for that Artwork will be refunded in full in accordance with Section 4.
Images are prepared to represent Artworks accurately, but screen settings, photography, lighting, texture and scale can cause reasonable visual differences. Dimensions, medium, edition information, framing and known material condition information stated on the listing form part of the product description.
Natural variation, artist technique, texture, handmade characteristics and disclosed age-related or material characteristics are not defects merely because they differ from a digital image.
When you place an order, payment for the full order amount will be collected at checkout through our payment provider. Following successful payment, you will automatically receive an Order Confirmation.
Because many Artworks offered through NUQT are original, unique or one-of-one works that may remain in the Artist's possession until sold, every order remains subject to verification of the Artwork's availability with the Artist, notwithstanding that payment has been collected and an Order Confirmation has been issued.
The Order Confirmation confirms that NUQT has received your order and payment. It does not constitute a guarantee that the Artwork remains available and does not prevent NUQT from cancelling the affected order if the Artist subsequently confirms that the Artwork is unavailable.
If the Artist confirms that the Artwork is available, NUQT will proceed with fulfilment. No additional availability confirmation is required from NUQT unless NUQT chooses to provide one.
If the Artwork is unavailable, NUQT may cancel the affected order and will refund 100% of the amount paid for that Artwork, including any delivery charge collected specifically for that Artwork where applicable, to the original payment method. If an order contains multiple Artworks, cancellation and refund may be limited to the unavailable Artwork unless the remaining order cannot reasonably be fulfilled.
Subject to any rights that cannot lawfully be excluded under applicable law, NUQT will have no further liability arising solely from the Artwork being unavailable, including any claim for loss of opportunity, price difference, disappointment, or indirect or consequential loss.
NUQT will initiate the refund promptly after confirming unavailability. The time required for the refunded amount to appear in the customer's account may depend on Stripe, the card issuer, bank or other payment provider and is outside NUQT's direct control.
Prices will be shown in the currency stated on the Platform. The checkout will identify charges collected from you, including delivery and applicable taxes where required. Customs duties, import taxes or destination charges not collected at checkout may be payable by the recipient.
Payments are processed through third-party payment providers. NUQT does not require customers to provide full card numbers directly to NUQT where the payment provider hosts or tokenises the payment process.
Delivery estimates are not guaranteed. International deliveries may be delayed by customs, carrier restrictions, inspections, weather or events outside reasonable control.
Risk of accidental loss or damage passes in accordance with the Shipping & Delivery Policy and applicable law. Title to the Artwork passes to the buyer only after the sale is validly completed, full cleared payment is received and the Artwork is delivered, subject to any mandatory law.
You must inspect the outer packaging and Artwork promptly on delivery and follow the damage-reporting process in the Shipping & Delivery Policy.
Where a Certificate of Authenticity is stated as included, NUQT will arrange for the certificate supplied or signed by the Artist to accompany or be delivered in connection with the Artwork.
Statements concerning authorship, medium, date, edition and provenance are based on information supplied by the Artist and records reasonably available to NUQT. NUQT will not knowingly list counterfeit work and may suspend a transaction where authenticity concerns arise.
Returns and cancellations are governed by the NUQT Returns, Refunds & Cancellation Policy. Nothing in these Terms limits rights that cannot lawfully be excluded under UAE consumer-protection legislation.
Commissioned, personalised, made-to-order or otherwise customer-specific Artworks are non-cancellable and non-returnable once production or customisation has commenced, except where a qualifying defect, transit damage, material non-conformity, authenticity/title issue, or a mandatory legal right applies.
Purchase of a physical Artwork transfers ownership of the physical object only. Copyright and other intellectual-property rights remain with the Artist or other rights holder unless expressly transferred in a separate signed writing.
You may not commercially reproduce, mint, tokenize, license, merchandise, alter for commercial exploitation, or use images of an Artwork beyond rights granted by law or by the rights holder.
You must not misuse the Platform, attempt unauthorised access, commit fraud, use stolen payment credentials, submit unlawful or knowingly false content, interfere with security, scrape the Platform in a manner prohibited by law, or infringe third-party rights.
Reviews must reflect genuine experience and must not be defamatory, deceptive, paid-for without disclosure, or otherwise unlawful.
We may conduct reasonable identity, payment, sanctions, fraud or source-of-funds checks for high-value or unusual transactions. We may decline a transaction where required by law, a payment provider, a financial institution or our compliance controls.
NUQT does not exclude or limit liability where doing so is prohibited by applicable law. Subject to that limitation, NUQT is not responsible for indirect or consequential loss that was not reasonably foreseeable from a breach.
For claims relating to a specific order, and to the maximum extent permitted by law, NUQT's aggregate contractual liability will not exceed the amount paid to NUQT for that order, except where a higher or uncapped liability is required by law.
Personal data is handled under the NUQT Privacy Policy and Cookie Policy. Transactional communications may be sent as necessary to administer your order. Marketing communications will be sent only on a lawful basis and can be opted out of.
These Terms are governed by the laws applicable in the United Arab Emirates. The parties should first attempt good-faith resolution through NUQT customer support. Subject to mandatory consumer jurisdiction rules, disputes shall be submitted to the competent courts of Sharjah, UAE.
We may update these Terms prospectively. The version in force when your order is accepted will normally govern that order unless a change is required by law.

This Policy is additional to rights that cannot be excluded under applicable UAE consumer-protection law. If an Artwork is defective, materially misdescribed, counterfeit, not as contracted, or damaged in circumstances for which the seller is legally responsible, statutory remedies remain available.
NUQT does not accept returns or provide refunds because a customer changes their mind, no longer wants the Artwork, decides it does not suit their space, prefers another Artwork, or for any other change-of-preference reason. Artwork sales are final except in the limited qualifying circumstances stated in this Policy or where applicable law requires a remedy.
A return may be considered only where the Artwork: (a) was materially damaged in transit before or during delivery; (b) is not the Artwork ordered; (c) is materially inconsistent with the description, dimensions, medium, edition status or other material information in the listing; (d) has a significant pre-existing condition issue that should have been disclosed but was not; (e) is subject to a substantiated authenticity, authorship or title issue; or (f) must otherwise be remedied under applicable UAE law.
Commissioned, personalised, made-to-order, customised, customer-framed or otherwise customer-specific Artworks are non-cancellable and non-returnable once production or customisation has commenced, except where a qualifying defect, damage, material non-conformity, authenticity/title issue, or mandatory legal right applies.
If visible damage exists, photograph the unopened outer package before opening. Photograph the packaging and artwork during unpacking and, where reasonably possible, record the unpacking process. Notify NUQT as soon as reasonably possible and preferably within 48 hours of confirmed delivery, providing the order number, photographs/video and a description of the issue. Retain all packaging and protective materials until NUQT confirms that they may be discarded. The 48-hour period is intended to preserve evidence and facilitate courier/insurance claims and does not remove any right that cannot lawfully be limited.
Because Artwork sales are final, cancellation after NUQT has issued final order acceptance is not guaranteed. Contact NUQT immediately if cancellation is requested before dispatch. NUQT may agree to cancellation where the Artwork has not been dispatched and no non-refundable artist, customisation, payment, packaging, logistics or other third-party cost has been incurred. Mandatory cancellation rights, if any, remain unaffected.
Where NUQT approves or is legally required to provide a refund, the refund will normally be initiated to the original payment method after the Artwork has been returned and inspected, or after NUQT otherwise confirms entitlement. Customers must not send an Artwork back without NUQT's written return authorisation and instructions. For high-value Artworks, NUQT may require collection or return through a specified insured or specialist art-logistics provider. Bank/payment-provider processing times are outside NUQT's control, subject to any mandatory legal timeline.
NUQT may deliver within the UAE and to selected international destinations shown at checkout or agreed in writing. Some Artworks may be unavailable for certain destinations because of size, value, material, carrier, sanctions or customs restrictions.
NUQT and/or the Artist will use packaging reasonably appropriate to the Artwork and transport method. High-value shipments may require specialist art logistics, crating, declared-value cover or separate insurance.
For cross-border orders, the customer is responsible for accurate recipient information and, unless checkout expressly states otherwise, destination-country customs duties, import VAT/taxes, brokerage and clearance charges. Refusal to pay destination charges may result in return costs being deducted from amounts refundable to the extent permitted by law.
Signature, ID or delivery appointment may be required for high-value orders. Customers should not authorise unattended delivery for valuable Artwork unless expressly agreed. Inspect packaging promptly and preserve all materials if a claim may be required.
Dates are estimates unless NUQT expressly guarantees a date in writing. NUQT will provide reasonable updates for material delays and will comply with mandatory rights applicable to delayed or failed delivery.
Listings will state, based on Artist information, whether a work is an original, edition, print, photograph, sculpture or other format. For editions, the listing should state edition size and number where applicable.
Where included, the certificate should identify the Artist, title, year, medium, dimensions, edition information if any, image/reference, Artist signature and date. A certificate supports provenance but does not transfer copyright.
Newly created works are expected to be in the condition described. Older, previously exhibited or consigned works may have disclosed characteristics or wear. Material condition issues known to NUQT will be described where commercially relevant.
Colours, surface texture, gloss, metallic effects, depth and scale may appear differently on screens. Customers should rely on stated dimensions and request additional images or information before purchase where a characteristic is material to their decision.
